Anthony P. Alvino pled no contest to charges of misconduct with a motor vehicle and evading responsibility.
The plea agreement offer accepted by Alvino took into account the state's inability to prove how much alcohol was in his system.
During the hearing, Judge Terrence Sullivan addressed the court and said that although witness accounts make it seem likely Alvino had consumed alcohol on the night of the incident, since Alvino fled the scene, there is no way to be sure. As a result, alcohol consumption could not be taken into account in the sentencing.
"I have no idea wether you were intoxicated, impaired or cold sober," Sullivan said to Alvino.
Alvino was sentenced to 37 months in prison and will serve five years probation.
